Trading Whilst Insolvent

Frenkels Forensics is regularly instructed by former directors of limited companies who have been pursued by liquidators for trading whilst insolvent.  This is now quite a commonplace type of litigation.

Our role in such cases is to:

• Consider in detail the company’s trading leading up to the liquidation.
• Form a view as to the appropriateness of the actions of the directors leading up to the liquidation, e.g. preferential payments.
• Consider whether the directors were entitled to pay dividends out when they did, based on the financials of the company (as restated by us as may be necessary).
