Crime And Fraud Case Study

Our crime and fraud team were recently instructed by solicitors acting for a Defendant (‘D’) accused by his former employer of theft. D’s worked in a shoe repair and key-cutting shop, and his theft had been captured on the shop’s CCTV.

Police investigations uncovered cash deposits in the region of £430,000 made by D during his employment. These deposits were over and above the sums paid as wages, and the police concluded they must be criminal gains. D was, accordingly, charged with theft and converting criminal property.

D’s solicitors approached our crime and fraud team to see if anything could be done to dispute the figures forwarded by the police. Our investigations indicated that the majority of D’s wages had been paid cash in hand instead of from the payroll, and that his employer had provided inaccurate wage information to the police. We also established that D had other income streams, including the sale of second-hand cars.

In light of our findings, the charges relating to the £430,000 were dropped, and D avoided a custodial sentence. Unfortunately for his employer, our uncovering of their potential fraud led the police to take action against them.
